Skypass Elite is a for rent/resale by owner advertising company. We provide marketing services to timeshare owners who wish to rent or sell their timeshare interests.

We are:

• Not a real estate broker
• Not a closing company
• Not a law firm
• Not affiliated with any timeshare resort
• Not affiliated with RCI, Interval International, or any exchange company

We do not negotiate transactions, collect buyer funds, or complete closings. We strictly provide advertising and marketing services.

By using our services, you agree that you:

• Provide accurate and complete ownership information
• Remain responsible for all maintenance fees, taxes, mortgages, and assessments
• Comply with your resort’s transfer or rental requirements
• Review and approve all offers before accepting
• Handle negotiations and closing directly or through a third party of your choice

If you hire a broker, attorney, or closing company, their fees are separate and not controlled by Skypass Elite.

Skypass Elite charges an upfront advertising and marketing fee.

• Marketing packages may cost up to $9,995.00 per property, depending on ownership parameters.
• Fees are due upon activation of services.
• Confirmation is provided after payment authorization and receipt of a signed agreement.
• Listings are typically placed within approximately 72 hours of verified payment authorization.

The initial advertising term is ninety (90) days.

• After the initial 90-day period, we will continue advertising at no additional cost until the property is rented, provided the owner notifies us before each 90-day term expires.
• Owners must request extensions prior to the expiration of each 90-day period.

Failure to request extension may result in removal of the listing.

Owners are entitled to a full refund within ten (10) business days of receiving confirmation of the signed agreement.

After the 10-business-day cancellation period expires, marketing fees are non-refundable except as required by law or stated in your service agreement.

Skypass Elite does not guarantee:

• That your property will rent or sell
• Any specific timeframe
• Any specific rental or sale price
• Any number of inquiries

Marketing results depend on market conditions, seasonality, resort demand, pricing, and buyer interest.

We are not involved in negotiations or closings and therefore do not track or guarantee success rates.

Skypass Elite does not provide real estate brokerage services and is not licensed as a real estate broker in California or elsewhere in the United States. We operate strictly as an independent advertising company.

All content on this website — including text, graphics, logos, images, and software — is the property of Skypass Elite and protected by applicable intellectual property laws.

Content may not be copied, reproduced, or distributed without written permission.

You agree not to:

• Use our services for unlawful purposes
• Submit false or misleading ownership information
• Attempt to interfere with website functionality
• Upload harmful code or malware
• Attempt unauthorized access to our systems

To the fullest extent permitted by law, Skypass Elite shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability shall not exceed the amount paid for the marketing services.

All services are provided “as is” and “as available” without warranties of any kind, express or implied.

Our website may contain links to third-party websites. We are not responsible for their content, policies, or practices.

By opting into SMS communications from Skypass Elite, you agree to receive messages related to appointment scheduling, rental updates, account notifications, and promotional communications.

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive the right to participate in any class action lawsuit.

These terms are governed by the laws of the State of Florida.

We reserve the right to update or modify these terms at any time. Continued use of our services constitutes acceptance of the revised terms.

If any provision of these terms is found unenforceable, the remaining provisions remain in full force and effect.
